Since November of 2005, Barkan Neff Handelman Meizlish represents a group of current and former Ohio Store Managers of Family Dollar Stores, Inc. in two lawsuits filed in federal court, one in Cincinnati, Ohio and one in Columbus, Ohio. The complaint alleges that Family Dollar Stores, Inc. intentionally and repeatedly misclassified the Ohio Store Managers as employees who are exempt from the entitlement of overtime. Store Managers were not paid for time spent working beyond 40 hours in one week and were not paid time-and-one half for all hours worked over 40 in one workweek.
Multiple cases have been filed against Family Dollar Stores, Inc. around the country by other law firms. All of the cases were consolidated by the Panel on Multidistrict Litigation to the federal court in Charlotte, North Carolina. The case is assigned to United States District Judge Graham Mullen.
